Photo Session Agreement: Please bear in mind that every effort is taken to provide the best experience to you and your family for your session. With that said, there are some contractual formalities that must be stated and agreed to prior to our session for clarity. Please be on time for your appointment. If you are late, your appointment will be for the time contracted, not for the hourly amount. Cancellations must be in writing and within 48 hours of appointment time. A non-refundable fee date retainer is required as well as a signed contract before holding your time slot. If you have to cancel, the retainer can be applied towards a new date if cancelled with 48 hours notice of your appointment. Travel fee (if applicable) is NON-REFUNDABLE. Although extreme care will be taken with the images and photographs taken, the photographer limits any liability for loss. Damage or failure to deliver pictures or prints, if selected, for any reason would result in the return of retainers. LIMIT OF LIABILITY. Client acknowledges and understands that the Photographer(s) cannot guarantee that any specific photo will be taken. The Photographer(s) will make every effort to accommodate Client’s wishes and acknowledges that there is a reasonable expectation of professional quality consistent with the photographer’s work. The client understands that the work on display through websites, prints, etc. has been retouched. The Photographer(s) cannot be held liable for factors over which they have no control which may affect the quality of the photographs, such as Client lateness and photogenicity. The Photographer(s) has the right to refuse to produce any image that could violate libel or copyright laws, or in the course of its production could cause or contribute to bodily injury, death, equipment damage or property damage or destruction. Pricing is defined on The Photographer(s)’ standard price list in effect at the date of this contract. Orders placed after the event are billed at the rates in effect on the most recently published price list. Credits included in covered package are not redeemable as cash or as a deduction from coverage package price. All purchases over the amount of included photographs will be billed to Client. Any additional retouching requested by Client will be billed at $120 per hour or $120 per image, whichever is greater. NOTICE OF COPYRIGHT. It is illegal to copy or reproduce the physical photographs or digital files without the Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. If the client purchases digital negatives, they are allowed to make reproductions of photographs for their own personal use, all other reproductions must go through the Photography Studio. PRIVACY STATEMENT: All information provided via any of the intake forms will NOT be shared with any third parties. This contract incorporates the entire understanding of the parties. Any modifications to this contract must be in writing and signed by both parties.

Model Release: Only check box if you are okay with my sharing your images as described above. For valuable consideration received, I grant to deSaint Studios("Photographer") the absolute and irrevocable right and unrestrictedpermission concerning any photographs that she has taken or may take of me (or my child(ren)) or in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the Internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if he/she so chooses. I release and discharge Photographer from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom he/she took the photographs. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns
